Maybe you bought a rental years ago as a retirement plan. Maybe it was your first house, or you inherited it with tenants already living there. Either way, late rent, repair calls and turnover add up. If you’re ready to sell rental property with tenants in Indiana, you have more options than you might think.

This page walks through those options and where an as-is cash sale fits. For the legal step-by-step, read our guide to selling a house with tenants in Indiana. For your specific situation, talk to an Indiana real estate attorney.

Selling rental property with tenants in Indiana

The lease usually comes with the house

A sale generally doesn’t cancel an existing lease. The buyer steps into your shoes as landlord, and the tenants keep living there under the same terms until the lease ends or is properly ended. Read your lease for any clause about a sale.

Showings and access

Indiana law says a tenant can’t unreasonably refuse to let the landlord in to show the unit to buyers. In return, the landlord has to give reasonable notice, come at reasonable times, and can’t use entry to harass the tenant (IC 32-31-5-6).

A traditional listing can mean weeks of showings in someone else’s home. With a cash buyer, it’s usually one walk-through.

Security deposits

This is the piece landlords most often overlook. After a good-faith sale, you stay responsible for each tenant’s security deposit for one year after you give the tenant written notice of the sale. That changes only if the buyer notifies the tenant that it’s taking over that responsibility and you transfer the deposit to the buyer at closing (IC 32-31-3-19).

Whoever owns the unit when a lease ends is the one who must return the deposit, minus itemized deductions, within 45 days after the lease ends and the tenant moves out (IC 32-31-3-12). So put the deposit handoff in writing with any buyer, including us.

Before you talk to buyers, pull together:

  • A copy of each lease
  • The deposit amount for each tenant
  • A rent ledger showing who’s paid and who’s behind
  • Any notices you’ve served or court papers filed

Problem tenants and evictions in Lake County

If a tenant has stopped paying or is damaging the place, you may be weighing an eviction against simply selling. Yes, you can sell a house with bad tenants. But first, know the rules that apply either way.

A landlord can’t change the locks, take off doors, or shut off utilities to force a tenant out without a court order (IC 32-31-5-6). If rent isn’t paid, Indiana law lets a landlord end the lease with at least 10 days’ notice, unless the lease says otherwise or the tenant pays in full first (IC 32-31-1-6).

In Lake County, the County Division of Lake Superior Court hears evictions on its small claims dockets. That includes Room 2 in Crown Point and Room 4 at the Hammond courthouse. Small claims is meant to be informal, but an eviction still costs time, filing fees and missed rent. An Indiana landlord-tenant attorney can tell you what to expect.

You don’t have to finish an eviction to sell. Some landlords sell with the case still open; others wait until the unit is empty. Either way, get it in writing: how the tenants, the deposits and any open case will be handled.

Deferred maintenance and city rules

Years of turnover leave their mark: worn floors, a tired kitchen, an old furnace, a roof that’s been patched more than replaced. Fixing all of that before a sale can take months and a big chunk of your equity. Selling as-is means you skip the make-ready. If the list is long, our page on selling a house that needs repairs goes deeper.

If your rental is in Gary, the city runs a rental registration program under ordinance C.P.O. 2012-79. According to the Gary Building Department, owners register each rental unit every year at $5 per unit, and a unit can be inspected when its tenant, or someone renting within 300 feet, files a complaint. A new owner must register within 30 days of getting title. If your registration has lapsed or there’s an open complaint, mention it up front.

Code violations and back taxes can come along too. See selling a house with code violations in Lake County and selling when you’re behind on property taxes.

How a cash sale fits for landlords

  • Tenants can stay. You don’t need to empty the house or time the sale to a lease ending.
  • One walk-through. Set up with your tenants, with proper notice.
  • No repairs or cleanout. We buy as-is and consider houses in any condition.
  • You pick the closing date. A cash purchase isn’t held up by a lender, so timing is mostly title work. It’s often weeks, not months.
  • Clear numbers. The written offer spells out who pays which closing costs. No agent commissions, and no fees charged by us.

Most of what we buy is single-family houses. Own a duplex or small multi-family? Reach out anyway, and we’ll tell you straight if it’s a fit. We buy rentals all over Lake County. See how selling works in Gary, Hammond, East Chicago or the rest of Lake County.

Taxes: talk to a CPA before you sign

Selling a rental isn’t taxed the same way as selling the home you live in. Things like the depreciation you’ve claimed over the years, or whether a like-kind (Section 1031) exchange makes sense, can change what you keep. We don’t give tax advice. A CPA can run your numbers before you commit to any sale.

How selling your house for cash works

Three steps to a fast cash sale. You stay in control the whole way, and you can stop at any point.

  1. Tell us about the house

Fill out the short form or call or text us. We’ll ask a few questions about the property and what you need.

  2. Get a written cash offer

We take a look at the house, in person or by photos, and give you a clear written offer. No obligation, no fees.

  3. Close fast, on your date

Cash means no lender to wait on, so you can close fast, or later if you need time. We close at a local title company and you get paid at closing.

Common questions

Can I sell my rental property in Indiana with tenants still living there?

Yes. A sale generally doesn't cancel an existing lease, so the buyer becomes the new landlord under the same terms. Check your lease for any clause about a sale, and see our guide to selling a house with tenants in Indiana for the step-by-step.

Do I have to evict a bad tenant before I sell?

No. You can sell with a problem tenant in place, or with an eviction case still open. Get it in writing how the tenant and any open case will be handled, and talk to an Indiana attorney about the eviction itself.

What happens to my tenants' security deposits when I sell?

Under Indiana law, you stay responsible for the deposits for one year after giving tenants written notice of the sale. That changes if the buyer notifies the tenants that it's taking over that responsibility and you transfer the deposits at closing. Put that handoff in the purchase agreement.

Do my tenants have to let buyers see the unit?

Indiana law says a tenant can't unreasonably refuse entry to show the unit to buyers. You have to give reasonable notice and come at reasonable times. Selling to a cash buyer usually means one walk-through instead of repeated showings.

Do you buy duplexes and small multi-family rentals?

Most of what we buy is single-family houses. If you own a duplex or a small multi-family building in Lake County, reach out anyway. We'll tell you straight if it's a fit.

Does Gary's rental registration matter if I'm selling?

It can. Gary requires rental units to be registered every year, and a new owner has to register within 30 days of getting title. If your registration has lapsed or there's an open complaint, mention it up front so nobody is surprised.
