What we collect when you use our website or contact us, why we collect it, who helps us handle it, and the choices you have.

This Privacy Policy explains how Penguin Capital LLC (“Penguin Capital,” “we,” “us”) collects, uses, shares and protects information when you visit our website, fill out our offer form, or call or text us. Penguin Capital LLC is a company based in Whiting, Indiana that buys houses directly from homeowners in Lake County, Indiana.

The short version: we collect what we need to respond to you about your property, we don’t sell your personal information, and we don’t share your mobile number or text-message consent with anyone for marketing.

Information we collect

Information you give us on the offer form

When you request an offer, we ask for:

  • the property address
  • your name
  • your phone number
  • your email address
  • your selling timeline
  • the property’s condition (optional)
  • your reason for selling (optional)

Right above the form’s submit button, a notice explains that by submitting the form you agree to calls and text messages from Penguin Capital about your property inquiry. When you submit, we keep a record of that consent: the date and time, the page where you agreed, the exact consent wording you saw, your IP address, and your browser’s user agent (a short description of your browser and device). We keep this record so we can show when and how you gave permission.

Information from calls, texts and emails

If you call, text or email us, we keep the phone number or email address you use and the content of our conversations. That includes details you share about the property, your timing and your situation.

Address suggestions

As you type in the address box, the text you’ve typed is sent through our server to the Photon geocoding service, operated by komoot, so we can suggest matching addresses. Our server does not forward your IP address to Photon. Photon receives only the address text, along with technical information about our server’s request. You can read komoot’s privacy policy.

Spam protection

Our forms use Cloudflare Turnstile to tell real people apart from automated bots. Turnstile looks at technical signals from your browser and device, such as your IP address and browser characteristics. It may use storage on your device that is strictly necessary for bot detection.

Website analytics

We use Cloudflare Web Analytics to understand how the site is used in general, such as which pages are viewed, which sites referred visitors, and browser and device types. It does not use cookies, and we use it only for overall site statistics, not to identify or follow individual visitors.

Technical information

Like any website host, our hosting provider automatically processes technical information such as IP addresses and request details to deliver and protect the site.

Cookies and tracking

We don’t use advertising cookies or tracking cookies, and we don’t follow you across other websites. The only browser storage involved is what Cloudflare Turnstile may need for bot detection. Because we don’t track visitors across sites, we don’t change our practices in response to “Do Not Track” signals.

How we use information

We use the information described above to:

  • respond to your inquiry and talk with you about your property
  • evaluate the property and prepare a written offer
  • schedule walkthroughs and coordinate a closing if you decide to sell
  • send calls and texts you’ve agreed to, and honor opt-out requests
  • keep records of consent and opt-outs
  • protect our website and forms from spam, fraud and abuse
  • keep business, tax and legal records, and comply with the law

How we share information

We do not sell your personal information. We share it only as described here.

Service providers. We use a small number of companies to run our website and business. They handle information on our behalf:

  • Cloudflare hosts the website (Cloudflare Pages and Workers), provides security and spam protection (Turnstile), provides cookieless analytics (Web Analytics), and stores a backup copy of form submissions in a Cloudflare D1 database. See Cloudflare’s privacy policy.
  • Google Workspace. Our customer records are kept in a Google Sheet in our Google Workspace account, and new-inquiry alerts are sent to us by Google email. See Google’s privacy policy.
  • komoot (Photon) receives the address text you type, as described above, to suggest addresses.
  • Phone and text-messaging providers carry the calls and texts we use to get back to sellers.

Completing a sale you agree to. If you sign a purchase agreement, we share the property and contact details needed to close with the people involved. That includes the title company, attorneys, any lender or lienholder being paid off, and any other buyer named in your purchase agreement.

Legal reasons. We may disclose information if required by law, such as in response to a subpoena or court order. We may also disclose it when reasonably necessary to protect our rights, investigate fraud, or protect someone’s safety.

Mobile information. We do not share, sell, or provide your mobile phone number or text-message (SMS) consent and opt-in information to third parties or affiliates for marketing or promotional purposes. None of the sharing described above includes your mobile number or SMS consent being used for anyone’s marketing.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Calls and text messages

If you agree, Penguin Capital may call and text you about your property inquiry. We may use automated technology or prerecorded messages. Message frequency varies with your inquiry. Message and data rates may apply. Agreeing is not a condition of any purchase or sale.

To stop texts, reply STOP to any message. You may get one confirmation text. Reply HELP for help. You can also opt out of calls or texts in any other reasonable way, such as telling us on the phone or in a text. We’ll honor your request promptly. Our Terms include the full text-message program terms.

How long we keep information

We keep inquiry and offer information for as long as we need it to talk with you, follow up on an offer, complete any purchase, and keep business, tax and legal records. We keep records of consent and opt-outs for as long as we may need to show that we had permission to contact you or that we honored your request. You can ask us to delete information we no longer need, as described below.

How we protect information

The website is served over an encrypted connection (HTTPS). Access to inquiry records is limited to the people who need it to respond to you. We use established providers that maintain their own security programs. No website, email or storage system is perfectly secure, so we can’t promise absolute security. We’ll take reasonable steps to protect your information and to respond if something goes wrong.

Your choices and requests

You can:

  • opt out of texts by replying STOP, or opt out of calls and texts by telling us
  • ask what personal information we have about you
  • ask us to correct information that’s wrong
  • ask us to delete your information, except records we need to keep for legal reasons, such as a record that you opted out

Indiana residents

Indiana’s Consumer Data Protection Act (IC 24-15) took effect on January 1, 2026. It applies to businesses that, in a calendar year, control or process personal data of at least 100,000 Indiana consumers, or at least 25,000 Indiana consumers while making more than half their gross revenue from selling personal data. Based on our size, we don’t believe the Act currently applies to Penguin Capital.

Even so, we’ll honor reasonable requests from Indiana residents to confirm, access, correct or delete their personal information. We don’t sell personal data, we don’t use it for targeted advertising, and we won’t treat you differently for making a request.

Children

Our website is meant for adults who own or are responsible for real estate. It is not directed to anyone under 18, and we don’t knowingly collect personal information from children. If you believe a child has sent us information, contact us and we’ll delete it.

Our site links to other websites, such as government offices and the services named above. We aren’t responsible for their privacy practices, so please review their policies.

Changes to this policy

We may update this policy from time to time. When we do, we’ll change the “Last updated” date at the top of this page. If a change materially affects how we use information we already have, we’ll take reasonable steps to let you know.
